1. Introduction

These General Conditions of Sale (CGV) apply to all singing lessons, training and items sold via the website.www.fabriceyde.com by Fabrice Yde. By reserving a course, registering for training or purchasing an item, the customer accepts these General Terms and Conditions.

2. Description of Services

2.1 Singing Lessons

Course Types

  • We offer two categories of singing lessons: individual and group. Individual lessons allow a personalized approach while group lessons encourage group learning.

Target audience

  • Our courses are aimed at all age groups: children, adolescents and adults. The programs and teaching methods are adapted according to the age and level of the participants.

Course Terms

  • Courses can take place in person, in our dedicated premises, or online via suitable digital platforms. The times and frequency of lessons will be determined in agreement with the student (or legal guardian, in the case of minors) during registration.

Participant Engagement

  • Participants undertake to follow the program of the course for which they have registered, in accordance with the agreed times and terms. In the case of group lessons, participants also undertake to respect the rules of group conduct.

Modification or Cancellation of Courses

  • We reserve the right to modify schedules or cancel courses in the event of force majeure or unforeseen circumstances. In such a case, we undertake to notify participants as soon as possible and to offer alternative solutions.

2.2 Training and workshops

Types of Training

  • We offer various types of training and workshops, designed to deepen singing skills and explore specific aspects of vocal technique. Formats can vary between intensive sessions, thematic workshops, and continuing training over a longer period.

Target audience

  • Our training and workshops are open to all levels, from beginners to advanced singers. Each training specifies the level required or recommended for optimal participation.

Training Modalities

  • Training can take place in person in our equipped premises or online via interactive platforms. The dates, times, and duration of the training will be specified in the description of each offer and during registration.

Registration and Payment

  • Participants must register for training and workshops before the specified deadline. Payment must be made in accordance with the conditions specified during registration. In the case of paid training courses, a place is only guaranteed after receipt of full payment.

Cancellation and Refund

  • In the event of cancellation by the participant, the refund or postponement conditions will be applied as defined at the time of registration. We reserve the right to cancel or postpone training in exceptional circumstances, with a full refund or rescheduling offered to registered participants.

Intellectual property

  • The content and materials provided during training and workshops are protected by copyright and may not be used outside of the training without prior permission.

3. Sale of Items

3.1 Item Types

  • We offer for sale a selection of items designed especially for singers and singing enthusiasts:

    • Well-being Kits for Singers: These kits include products for making infusions and inhalations, helping with relaxation and vocal well-being.

    • Singing Accessories: This category includes tools such as the Laxvox, the Flow Ball, and other accessories that develop breathing and facilitate the practice of singing.

    • Merchandising: We also offer a range of t-shirts and other singing-related merchandising items, perfect for amateurs and professionals.

3.2 Order and Payment

  • Orders for items can be placed directly on our website. Payment must be made at the time of ordering. We accept several payment methods, details of which will be specified during the ordering process.

 

3.3 Delivery

  • Items will be shipped to the delivery address specified when ordering. Delivery costs and times vary depending on destination and will be clearly indicated at the time of ordering.

 

3.4 Returns and Refunds

  • If an item does not meet your expectations, you have the option of returning it within a specified time after receipt, provided the item is in its original, unused condition. Return and refund procedures will be detailed on our site.

 

3.5 Warranty and Complaints

  • We guarantee the quality of our items. In the event of a defect or problem with a product, customers are invited to contact us for support under the terms of our warranty policy.

 

3.6 Product Modifications

  • We reserve the right to modify the items offered, their characteristics or their prices, without notice. However, these changes will not affect orders already confirmed.3. Prices and Payment Terms

4. Cancellation and Refund

4.1 Cancellation of Appointments

  • Less than 24 Hours in Advance: Any appointment canceled less than 24 hours before the scheduled time is considered due. For customers with a subscription, this appointment will be deducted from the package.

  • More than 24 Hours in Advance: Appointments canceled more than 24 hours in advance may be rescheduled based on existing availability. We will endeavor to find a new time slot that best suits the participant.

 

4.2 Reimbursement of Subscriptions

  • The subscription refund policy is under development and will comply with current Belgian legislation. We are committed to providing a fair solution for refunding or rescheduling unused courses in the event of cancellation of a subscription. The details of this policy will be communicated and updated in our General Terms and Conditions as soon as they are finalized.

 

4.3 Changes to Appointments by Fabrice Yde

  • We reserve the right to modify or cancel appointments in the event of unforeseen circumstances or force majeure. In such cases, we will offer to reschedule the appointment or offer a refund for canceled sessions, depending on the client's preferences.

5. Intellectual Property

5.1 Rights to Content and Materials

  • Educational Content: All materials and content provided during courses, training, and via our website, such as teaching methods, written documents, audio and video recordings, scores, and any other educational materials, are the exclusive property of Fabrice Yde or its content suppliers. These materials are protected by intellectual property laws, including, without limitation, copyright.

 

5.2 Use of Materials

  • Use Restrictions: The use of these materials is strictly limited to educational purposes in the context of courses and training offered by Fabrice Yde. Any reproduction, distribution, public communication, modification, or any other form of use of these materials outside the stipulated framework is prohibited without the prior written permission of Fabrice Yde or the rights holders.

 

5.3 Protection of Third Party Works

  • Respect for Copyright: When third party works are used as part of our services (for example, songs or texts protected by copyright), they are used in compliance with the rights of their respective owners . Participants undertake not to use these works outside the limits authorized by law or without the agreement of the rights holders.

  • Brands and Logos: The brands, logos and any other visual identity associated with Fabrice Yde are its exclusive property and cannot be used without prior authorization.

Intellectual Property Violation

  • Consequences of Violations: Any violation of the intellectual property rights of Fabrice Yde or third parties may result in legal action and claims for damages.

7. Modifications to the General Conditions of Sale

  • Communication: Any modification made to the General Conditions of Sale will be communicated to customers in a clear and visible manner. This communication may be made through our website, by email, or by any other means of communication that we deem appropriate.

  • Notice Period: Where possible, reasonable notice will be given before the new General Terms and Conditions come into force.

 

7.3 Acceptance of Changes

  • Application: Changes to the T&Cs will be considered accepted by customers if they continue to use our services after the date of entry into force of the new T&Cs.

  • Right of Refusal: If a customer does not accept the new T&Cs, he has the right to terminate his contract with Fabrice Yde, subject to compliance with the cancellation and termination conditions set out in the existing T&Cs.

  • Previous Version: A copy of the previous version of the General Terms and Conditions will be archived and available on request, to allow customers to become aware of the changes made.

  • Consultation of the T&Cs: Customers can consult the current version of the T&Cs at any time on our website or request them directly from our customer service.

8. Applicable Law and Dispute Resolution

8.1 Applicable Law

  • Jurisdiction: These general conditions of sale are governed and interpreted in accordance with Belgian law. Any contract concluded between Fabrice Yde and his clients is subject to this jurisdiction.

 

8.2 Place of Jurisdiction

  • Head Office: In the event of a dispute relating to the interpretation, execution or validity of these General Terms and Conditions, the competent court will be that of the location of the head office of the activity, i.e. the judicial district of Walloon Brabant (Nivelles).

 

8.3 Amicable Dispute Resolution

  • Prioritize Negotiation: Before resorting to legal action, Fabrice Yde and the client undertake to try to resolve any dispute amicably. This may include mediation or any other form of alternative dispute resolution.

 

8.4 Dispute Procedure

  • Notification of Dispute: In the event of disagreement or litigation, the customer is invited to first contact Fabrice Yde to present his complaints.

  • Response times: Fabrice Yde undertakes to respond to complaints within a reasonable time, with a view to finding a solution satisfactory for both parties.

 

8.5 Recourse to the Courts

  • Failure of Amicable Resolution: If attempts at amicable resolution fail, the parties retain the right to bring the dispute before the competent courts under Belgian law.
